(1) and (2) are copies of the relevant Malayan Proclamations for reference.

(3) is a draft submitted by Mr. Hazlerigg in May last. (See (1) on 54145/8). It has now been superceded by (4) and can be put by.

(4). Colonel O'Connor is going to discuss

with Colonel Bacon of the War Office the clause in Article 3(a) that all Laws existing prior to the Japanese occupation will be respected and administered.

We spoke. I explained that I had been wable to get in touch with Col. Bacon

paragraph (a) of. pointed out that (Art. 3 of the Military Administration Proclamation is expressed to be subject to order of the B.M. A. and to military exigencies. In the circumstances you

told me to leave it.

In the light of the news of the re-establishment of civil government in Houghong. legal basis for a military

administration seems

very shaky.
